Prenuptial and postnuptial agreements, and divorce settlements, are regularly used as protection against liability and divorce, and to structure tax affairs.
An appropriately worded prenuptial agreement can, for example, enable the transfer between spouses of significant assets beyond the scope of allowances without triggering a liability for gift tax. Beyond such tax arrangements, we negotiate prenuptial agreements for our clients in a national and international context at the beginning of a marriage or later on, and we represent them in disputes. We negotiate divorce settlement agreements and represent the spouses’ interests before family courts.
We take family members’ mobility into account from the outset and design prenuptial agreements to be ‘relocation-proof’; that is to ensure, in the event of divorce, that the agreements are also recognized by foreign courts.
