The Art of Tax Litigation
A Practical Workshop Across Jurisdictions

Tax disputes are on the rise worldwide. As tax authorities become more assertive and cross-border transactions more complex, taxpayers and their advisors face an increasingly challenging landscape when it comes to challenging tax assessments before the courts — and winning. Yet the procedural rules, strategic tools, and cultural dynamics of tax litigation differ dramatically from one jurisdiction to the next. What is effective in Germany may prove ineffective, or even counterproductive, in the United States. Likewise, a strategy that succeeds before the U.S. Tax Court may be entirely unsuited to proceedings in Germany.
Following on from last year’s FGS Symposium on Arbitration and Joint Audits, this year’s Symposium Session is entirely devoted to proceedings before the (tax) courts. Rather than a lecture-style presentation, this session is designed as an interactive dialogue. Based on a fictional international case study, the moderators and panelists will not only walk through their respective jurisdictions' procedural frameworks, strategic considerations, and recent developments — they will also invite participants to share their own experiences and insights from the floor. What has worked? What failed? What surprised you? This exchange across jurisdictions and professional cultures is at the very heart of what makes the IFA Congress such a singular gathering.
The session is moderated and co-presented by Dr. Christian Süß and Dr. Thomas Sendke (Germany), joined by distinguished tax litigators from different jurisdictions around the world. Together, the panel brings decades of front-line experience in tax controversy work across some of the world's most significant and complex tax systems.
