Navigating Cross-Border Taxation for Private Clients: Exit Tax, Residency and Special Tax Regimes

The mobility, flexibility and relocation of taxpayers plays a major role in a globalized and digitalized world. States react differently to this increased demand: On the one hand, many states make it more difficult for their taxpayers to relocate by levying an exit tax on certain assets. Even within the European Union, where Union law basically guarantees the freedom of movement of Union citizens, exit tax regimes have been tightened in recent years (e.g. in Germany). On the other hand, many countries are actively seeking to attract professionals and HNWIs. For this reason, special tax regimes (e.g. the Beckham Law in Spain, Swiss lump-sum taxation, or remittance basis taxation in the UK) are becoming increasingly important. However, these special tax regimes can have an impact on the taxpayer's residency under treaty law.
Susanne Mederer, Goetz Kempelmann and Thomas Sendke (all Flick Gocke Schaumburg) will provide insights on the interplay between exit tax and special tax regimes together with our dear colleagues Janet Gooi (Al Tamimi & Company), Jenny Klein (ENSafrica), Matthias Bizzarro (Bär & Karrer), Xavier Xivillé (Cuatrecasas): What are the current developments in exit taxation? What are the potential prerequisites for such tax regimes? And how does the competition between states for qualified and wealthy private individuals affect international tax and treaty law?
